Terms of Sales

 

1- REGISTRATION

Registration for one of our trips or one of our cruises implies your unreserved acceptance of our General Terms and Conditions of Sale. Your registration request must be completed and signed before being returned to XXXXXXXXXXX, together with a deposit. Receipt of this deposit implies reservation only to the extent of available places.
An invoice will be sent to you within 10 days of registration. Payment for the stay must be made in accordance with article 4 below. The balance must be paid 60 days before the date of departure, without reminder from us.
If the balance of the trip has not arrived within the fixed period, XXXXXXXXXX reserves the right to cancel the reservation without compensation. The deposit paid to XXXXXXXXXXXXX will remain acquired as a penalty.

2- FORMALITIES

You are required to comply with police and health regulations and formalities at all times during the trip. Under no circumstances can XXXXXXXXXXXXX be required to complete any individual formality whatsoever before departure (passport, visa, vaccination record, etc.) and throughout the duration of the trip, including the completion of customs formalities. of the country regulating the export of objects, such as antiques, protected objects, etc.
All the practical information given after registration is for information only and cannot engage our responsibility. They only concern French citizens. Persons of foreign nationality must inquire about administrative and health formalities with the competent embassies or consulates. Failure to comply with these obligations, the impossibility of presenting documents in order on the day of departure, any delay (even resulting from a case of force majeure during an air, rail or land pre-routing of which we are not a supplier ), can in no way engage our responsibility or cause costs to be borne by us.

3- SALE PRICE

Our sale price includes:​

  • Accommodation on the sailboat PHILOTHEE

  • Services of the professional skipper

  • Two Paddle available

  • Motorized dinghy

The price does not include:

  • The journeys (air or land) to reach the place of embarkation of the sailboat PHILOTHEE

  • Food / Drinks (skipper included)

  • Diesel fuel

  • Bedding (optional): 20 euros 

  • Services host(ess), cook, cocktail bartender from 90 euros per day

  • Boat cleaning upon disembarkation (compulsory): 200 euros

  • Port fees / Mooring fees

  • personal insurance (cancellation, theft of luggage, repatriation assistance)

  • Additional nights on board (on prior request)

  • Use of satellite telephone and email on the boat except in cases of absolute emergency (accident, death)

  • Activities on land requiring specific supervision (ski touring, mountaineering, diving, etc.)

  • personal extras (bar and restaurant drinks, gifts, souvenirs)

  • museum visits, city visits, paid excursions (horse, car or bike rental, plane, etc.)

  • Entrance(s) to the parks/reserves

Price-revision :

Our prices are displayed in euros and payments are made in euros. Our prices are updated each year, and these are communicated to you when you register before it is validated.

In accordance with the provisions of Article 19 of Law No. 92-645 of July 13, 1992, the price may be revised to take account of variations in particular:

  • the cost of transport linked in particular to the cost of fuel,

  • royalties and taxes relating to the services selected such as landing, embarkation and disembarkation taxes in ports and airports.

  • exchange rates applied to the trip or stay in question.

4- PAYMENT CONDITIONS AND METHOD OF PAYMENT

Payment terms and deadlines: By check or bank transfer payable to XXXXXXXXXXX. A deposit must accompany your registration form. Depending on your registration date, the payment deadlines are as follows:

  • if your registration takes place more than 60 days before the date of departure, the deadlines are as follows: 50% on the date of registration / balance at 60 days of departure

  • if your registration takes place within 60 days prior to the date of departure: 100% of the total price at registration (For any registration less than 15 days before departure, we will require payment by bank transfer or in cash)

The participant's access to the boat can only take place when the balance of the stay has been collected by xxxxxxxxx.
You will receive the invoice a few days after your registration, which will constitute confirmation of your registration.
A lack of payment beyond these dates will be considered as a cancellation on your part.

A cash box is set up for provisions, port taxes and consumables, only in cash. No invoice will be provided for the cash register.

 

5- CANCELLATION

From the participant
Any cancellation by the participant before departure must be sent to us by registered letter with AR or by email with a signed attachment. In the event of cancellation of the stay by the participant, the following scale of deductions will be applied:

  • If the cancellation occurs more than 60 days from the date of the beginning of the stay, the deposit paid to XXXXXXXXXX remains acquired as a penalty.

  • If the cancellation occurs 60 to 30 days before departure: 60% of the total price of the stay is due to the organizer.

  • If the cancellation occurs within 30 days of departure: the full price of the stay is due to the organizer. In this case, no refund will be made to the participant.

Cancellation by the organizer
Until the last minute, a cancellation may occur in imposed circumstances and beyond our control (problems related to the boat: material breakage, crew injured and unable to conduct the cruise, administrative problems, etc.).
In these cases of cancellation, the organizer undertakes to offer the participant either a replacement cruise or a full refund (excluding airfare and insurance), but no other compensation will be granted.

Cancellation for reasons beyond the responsibility of XXXXXXXXXX and that of the participant
Strikes, cancellation of the flight, earthquakes or other natural disasters directly or indirectly preventing the realization of the stay. In these cases, which are beyond the control of XXXXXXXXXX and that of the participant, the financial burden will be shared equally between XXXXXXXXXX and the participant. XXXXXXXXXX will therefore reimburse the participant 50% of the amount of the cruise if it has been paid in full, under the conditions provided for in these General Conditions of Sale.

6- TRANSPORT

The participant is solely responsible for his transport to the place of embarkation on the PHILOTHEE sailboat (air, train, bus, taxi, etc.). XXXXXXXXXX cannot therefore be held responsible in the event of cancellation, delay, accident, relating to transport.
However, we draw your attention to the constraints inherent in charter flights, the airline company being able to cancel or postpone a departure within 24 hours before or after the scheduled date. Therefore, we recommend that you bring refundable and/or modifiable tickets for your journey, and avoid important appointments on the days following your trip. Airport or terminal changes may also occur.

Baggage During air transfers, your baggage is the responsibility of the airline. Any disputes during these transfers must be handled directly between the participant and the carrier. For the rest of the trip, your luggage remains your own responsibility.

7- LIABILITY AND INSURANCE

XXXXXXXXXXXXXX is insured for professional civil liability with the companyXXXXXXXXXXX.
However, XXXXXXXXXXXXX cannot replace the individual civil liability that each participant must hold.

For travel, XXXXXXXXXXX asks the participant to be covered by travel assistance and repatriation insurance. Participants are asked to provide the organizer with a copy of the insurance certificate and to bring the original with them on their trip. Furthermore, it is strongly recommended that the participant take out cancellation insurance in the event of cancellation of the stay by them.

Responsibility

If unforeseen events or compelling circumstances involving the safety of the participant so require, XXXXXXXXXXXX reserves the right, during the circuits, directly or through its skipper, to modify the schedules or itineraries planned without the participant being able to claim to any compensation. Each participant must be aware that he may run risks of all kinds due to local conditions (distance from medical centres, lack of means of communication, poor state of certain infrastructures, etc.). He assumes them in his own name and in the name of his successors in full knowledge of the facts and undertakes not to hold XXXXXXXXXXXXX liable for them.

Participants must respect the instructions of the port, in particular it is forbidden to use the amenities on the quayside. Each port has amenities for users.

Participants must wear a safety life jacket for all trips on the deck and in the rubber dinghy, when the boat.

Minor children remain under the responsibility of their parents for the duration of boarding.

Participants declare that they are physically fit for the practice of sailing.

Each participant must have a valid identity card or passport.

The skipper reserves the right to oppose the boarding of any person who is not in order.

A good physical condition and a taste for community life are essential qualities to carry out the type of trips we offer. XXXXXXXXX reserves the right to expel at any time from a group a participant whose behavior can be considered as endangering the safety of the group or the well being of the other participants. No compensation would be due.

Neither XXXXXXXXXXXX nor the skipper of PHILOTHEE can be held responsible in the event of an accident during the duration of the stay, whether on board or during shore excursions, unless the fault of the organizer is proven;

Each participant must ensure that he meets the conditions for access to a country (passport and visa in good standing, if applicable). Neither the skipper nor XXXXXXXXX can be held responsible in the event that one or more participants are prohibited from entering a country;

The skipper is the only judge of the course and navigations. Neither he nor XXXXXXXXXX can be held responsible in the event of delays due to administrative contingencies, weather conditions, technical problems.

A delayed return cannot give rise to any indemnity or compensation. If the conditions do not allow access to the planned airport, the intermediate means of transport remain the responsibility of the participant.

8- DISPUTE

Any dispute that may arise will be systematically the subject of an attempt at amicable conciliation. If this does not succeed, it will fall under the jurisdiction of the courts.
